The petitioner seeks bail in connection with Takari P.S. Case No. 81 of 2014, registered under Section 304(B), 120(B) and 328 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is husband of the deceased and bail prayer of the petitioner has already been refused by this Court four times lastly on 15.11.2017 passed in Criminal Miscellaneous No. 44799 of 2017 with direction to the trial Court to conclude the trial of the petitioner within six months by taking all effective steps and if the trial of the petitioner is not concluded within six months, the petitioner would be at liberty to renew his prayer for bail. Patna High Court Cr.Misc. No.31354 of 2018(3) dt.08-08-2018 2/2 already been elapsed, but the trial of the petitioner is pending for prosecution evidences.

A report regarding the stage of trial of the petitioner has been received through letter No. 233, dated 23.07.2018, which disclosed that up till now, out of nine witnesses cited in the Chargesheet only seven witnesses have been examined in this case.

Having regard to the facts and the circumstances of the case and the observation made on 15.11.2017 passed in Criminal Miscellaneous No. 44799 of 2017, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-IX, Gaya in connection with Takari P.S. Case No. 81 of 2014 (S.T. No. 10 of 2016). (Rajendra Kumar Mishra, J) manish/- U T
