The Petitioner seeks bail in Nawada Town P.S. Case No.03 of 2017 instituted for the offence under Section(s) 25(1-b)a, 26, 35 of the Arms Act.

As per prosecution case, during course of raid in connection with Nawadah Town P.S. Case No.716 of 2016, the informant arrested non-FIR accused of the said case, namely, Rajesh Kumar Choudhary, and on interrogation he confessed his guilt and involvement of his companion and stated that the arms used in the said occurrence are kept concealed in the house of Nivi Kumar alias Shomesh Satyam (petitioner). The police raided the house of Nivi Kumar alias Shomesh Satyam (petitioner) and arrested him and on interrogation he told that due to fear of his

Patna High Court Cr.Misc. No.23724 of 2017 (2) dt.23-05-2017 2/2 parents, aforesaid arms are kept concealed in the house of Kunal Kumar. Thereafter, the informant raided the rented house of Kunal Kumar and on search recovered three loaded country made Katta and 11 live cartridges from the bed room of Kunal Kumar. Fire arms were seized and seizure list was, accordingly, prepared. From the seizure list itself, it appears that there is no recovery from the possession of this petitioner. Name of the petitioner was disclosed by Rajesh Kumar Choudhary. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No.03 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
