JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kharik P.S. Case No. 57 of 2016 instituted for the offence under Sections 324 and 326 of the Indian Penal Code.

It has been submitted that petitioner is in custody since 6.6.2016. His name has come in the confessional statement of coaccused Azad Sah as mentioned in paragraph-80 of the case diary. It has further been submitted that Azad Sah has already been granted bail by a coordinate Bench of this Court vide order dated 23.3.2017 passed in Cr. Misc. 13767 of 2017. From the written report it appears that petitioner is not named in the written report. It is alleged that son of Shobha Devi namely, Pintu Kumar got seriously injured due to explosion of

Patna High Court Cr.Misc. No.23691 of 2017 (2) dt.23-05-2017 2/2 bottle and later on, in course of treatment, he died. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Naugachia, Distt. Bhagalpur, in connection with Sessions Trial No. 121 of 2017 arising out of Kharik P.S.
