The petitioner is in custody since 12.06.2016 in a case registered for the offences punishable under Sections 20, 22 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
From the trouser pocket of the petitioner 50 sachets of Ganja weighing 114 grams, 150 sachets of Ganja weighing 358 grams and further 208 grams of Ganja recovered from the kiosk of the petitioner, hence, total 680 grams Ganja were recovered from the petitioner.
It is submitted by the learned counsel for the petitioner that the recovery is of small quantity. Mr. Sanjay Kumar Tiwary, learned counsel for the
Patna High Court Cr.Misc. No.39798 of 2016 (2) dt.22-09-2016 2/2 State does not controvert the quantity of recovery. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, the investigation has already been concluded. Considering the quantity of recovery coupled with the statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 297 of 2016 (N.D.P.S. Case No. 04 of 2016), subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Kundan (Dinesh Kumar Singh, J) U T
