Petitioner apprehends his arrest in Complaint Case No.80/2016, registered under Section 498A of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the petitioner is the husband of the complainant. The marriage was solemnized in the year 2007. The wife of the petitioner could not be able to give birth to a child and on account of this fact she filed a complaint making false and frivolous allegation. It appears that the complainant herself alleged in the complaint petition that she was driven out from her in-laws house in the year 2014 but the complainant filed the complaint
Patna High Court CR. MISC. No.39444 of 2019(2) dt.27-06-2019 2/2 case only in the year 2016. Marriage of the complainant with the petitioner was solemnized in the year 2007 but she did not ever complain about her ill treatment.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Uda-Kishunganj, Madhepura in connection with Complaint Case No.80/2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
