The petitioner apprehends his arrest in connection with Alauli P.S. Case No. 288 of 2014 registered for the offences punishable under Sections 341, 323, 325, 307, 504, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the present FIR has been lodged in retaliation to the earlier FIR filed by the wife of this petitioner on 15.07.2014 bearing Alouli P.S. Case No. 169 of 2014. It is further submitted that whatever injury is purported to have been found on the injured do not match with the allegations, as made in the FIR. Considering the aforesaid submissions and the facts that there is a case and counter case between the parties indicating the previous enmity and also taking note of the fact

No.30426 of 2015 (2) dt.14-08-2015 that the petitioner has no criminal antecedent, let the petitioner, in the event of his/their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Khagaria in connection with Alauli P.S. Case No. 288 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
