The petitioner seeks bail in connection with Laukaha P.S. Case No. 51 of 2023 registered for the offence punishable under Sections 363 and 366A of the Indian Penal Code. As per prosecution case, informant's minor daughter had gone for coaching class but did not return. Allegation against the petitioner and other accused persons is that they have kidnapped informant's daughter.
Learned counsel for the petitioner submits that the petitioner is father of the co-accused Prakash Paswan who have been falsely implicated in this case during investigation. he victim girl has already been recovered and given her statement under Section 164 Cr.P.C. in which she has not made any
Patna High Court CR. MISC. No.40820 of 2023(2) dt.14-07-2023 2/2 allegation against the petitioner. The petitioner has no criminal antecedent and he is languishing in jail custody since 11.04.2023. Charge sheet has already been submitted in this case and there is no chance of absconding or tampering with the evidence.
Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanharpur Madhubani in connection with Laukaha P.S. Case No. 51 of 2023.
