JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302,120B and 201/34 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that the informant came to know about a dead body within the jurisdiction of Basnahi Police station. The informant identified the victim as her husband Direndra Yadav due to his name being tattooed on the hand of the victim when suspicion was raised against the FIR named accused persons including the petitioner to have conspired and killed the husband of the informant.

It is submitted by the learned counsel for the petitioner that considering the suspicious nature of accusation co accused

Patna High Court Cr.Misc. No.32227 of 2015 (2) dt.07-08-2015 2/2 Rukesh Yadav and Sintu Yadav alias Mukesh Yadav have been granted anticipatory bail vide Cr. Misc. No. 29530 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Basnahi P.S. Case No. 42 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation will give liberty to the prosecution to file application before the learned court below to cancel bail bonds of the petitioner. (Dinesh Kumar Singh, J) Anil/- U T
