The petitioner has filed the instant application for grant of regular bail in connection with Jandaha P.S. Case no. 12 of 2020 registered under sections 25 (1-B) (a), 26 and 35 of the Arms Act and sections 20 and 22 of the NDPS Act. As per allegation in the F.I.R., a pistol loaded with two live cartridges was recovered from the possession of the petitioner while arms and ganja were recovered from the possession of other co-accused.

It is submitted by learned counsel for the petitioner that the petitioner is in custody since 27.01.2020. No recovery as alleged has taken place from his possession and co-accused Mukesh Paswan @ Mukesh Kumar Paswan has been enlarged

Patna High Court CR. MISC. No.38207 of 2020(2) dt.05-02-2021 2/2 on bail vide order dated 07.12.2020 passed in Cr. Misc. no. 32785 of 2020.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration petitioner being in custody since 27.01.2020, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Jandaha P.S. Case no. 12 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special Judge, Vaishali.
