JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 304 and 201/34 of the I.P.C. The prosecution case, in short, is that on 10.1.2017 the informant's father, namely, Balram Paswan went to Sandiha west of village regarding impregnation of cow. Cow came to the house but his father did not return. On 11.1.2017 his father was found in the sugar can field of Shivashray Singh in dead condition. Two sides of the field was found surrounded with necked iron wire with electricity. His father came in contact with electric wire, due to which he died. It is alleged that death of his father occurred due to necked iron wire raised by Arjun Singh and his son Vicky Kumar in his field.

Patna High Court Cr.Misc. No.23843 of 2017 (2) dt.24-05-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.4.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The case is under Section 304 of the I.P.C. The petitioner has been made accused merely on the basis of suspicion. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Rohtas at Sasaram in connection with Rohtas P.S. case No.6 of 2017.
