JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364A and 120B of the Indian Penal Code.

The accusation is of kidnapping the minor grand son of the informant.

It is submitted by the learned counsel for the petitioner that though the case was registered in 2003 but never any process was executed against the petitioner. More over, the victim in 164 Cr.P.C. statement has not alleged anything against the petitioner. Considering the fact that the case was instituted in 2003, this court is not inclined to interfere, however, let the learned court below consider the prayer for regular bail of

Patna High Court Cr.Misc. No.31734 of 2015 (2) dt.05-08-2015 2/2 the petitioner in case the petitioner surrenders within six weeks from today in connection with Bettiah Town P.S. Case No. 13 of 2003 pending in the court of learned Additional District and Sessions Judge IV, Bettiah, West Champaran.

This application is disposed of with the aforesaid observation/direction.
