JUSTICE SANJAY PRIYA ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Danapur R.P.F. Case No. 02 of 2017 instituted for the offence under Section-3 R.P. (U.P.) Act.

It has been submitted that the alleged article which is said to have been recovered from possession of this petitioner, was not put on TIP. It has further been submitted that police never prepared any seizure list.

From the written report, it appears that there is allegation that theft has been committed in the Railway Repairing lab of Telecommunication Department situated in the Railway Premises, Danapur. The written report is against unknown. It has been submitted that petitioner has no criminal antecedent. In such circumstances, the prayer for bail is allowed

Patna High Court Cr.Misc. No.24026 of 2017 (2) dt.22-05-2017 2/2 and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Danapur R.P.F. Case No. 02 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate (Railway), JM, Ara subject to condition that both the bailors should be close relatives of the petitioner.
