The petitioner apprehends his arrest in connection with Riga P.S. Case No.84 of 2019 registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about selling of the liquor in village-Pakari, the informant along with other police personnel reached there. On seeing the police party, one person started to flee away but he was apprehended, who disclosed his name as Ram Bahadur Sahni. On search, two bottles, each containing 180 ml. Indian Made Foreign Liquor were recovered from the possession of Ram Bahadur Sahni.

Patna High Court CR. MISC. No.39310 of 2019(2) dt.27-06-2019 2/2 Ram Bahadur Sahni disclosed the name of the petitioner, who succeeded to flee away.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has been disclosed by the co-accused Ram Bahadur Sahni. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Sitamarhi, in connection with Riga P.S. Case No.84 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
