Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in Sessions Trial No.64 of 2018 arising out of Surajgarha P.S. case No.169 of 2014 registered under Sections 147, 148, 149, 341, 323, 452, 380, 302, 506 of the Indian Penal Code, pending in the court of Sessions Judge, Lakhisarai.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the informant is an eye witness and he has

Patna High Court CR. MISC. No.2196 of 2021(3) dt.24-03-2021 2/2 identified the petitioner in the electric light who had entered into the house and committed murder of the sister of the informant by way of strangulation.

A report was called for from the court below regarding the stage of trial. It has been reported that out of eleven charge-sheeted witnesses, ten witnesses have already been examined and the trial is expected to be concluded within a period of three months.

Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Narendra/- U T
