This application is for grant of bail in connection with Parasbigha P.S.Case No.132 of 2016 for the offence under Section 395 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. but later on his name has transpired on the basis of confessional statement of the co-accused and he is in custody since 25.10.2016.
Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner stating that the petitioner has suppressed the fact that he is accused in five other cases also, as stated in Para 3 of the petition that there is no criminal antecedent against him. Having heard both sides and in view of the conduct of the
Patna High Court Cr.Misc. No.533 of 2017 (4) dt.17-03-2017 2/2 petitioner, I am not inclined to grant bail to the petitioner at this stage, however, considering the fact that he is in custody for about four months, the learned trial court is directed to expedite the trial of the case.
With the aforesaid observation, this application is dismissed.
