In this case vide order dated 20.4.2018 case diary was called for. From the case diary, learned counsel for the State submits that allegation of assault is against Vishawanath Sah, the other brothers of the petitioners herein. Mr. Prasun Sinha, referring to post-mortem report submits that only one injury was found on the person of the deceased which falsifies the allegation against these petitioners in view of the fact that in the case diary during the investigation the allegation of assault is specifically against Vishawanath Sah who is not the petitioner in this case and considering the fact

Patna High Court Cr.Misc. No.23025 of 2018(3) dt.17-05-2018 2/2 that they have no criminal antecedent.

Considering the above, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 127 of 2016 on the condition that bailors should be family members of the petitioners.
