1. Heard the parties.

2. Petitioner seeks regular bail in connection with Jamalpur P.S. Case No. 172/ 2022 dated 01.10.2022 registered for the offence(s) punishable under Section(s) 324 and 307 of the Indian Penal Code.

3. Mr. Shashi Saurabh, learned counsel for the petitioner submits that petitioner earlier preferred Cr. Misc. No. 43383/ 2023 for the relief of regular bail which was rejected by this Bench vide order dated 24.07.2023 with giving him a liberty to renew his bail prayer after examination of victim in his trial or after six months if within the said period the victim is not examined and in the light of said liberty, the petitioner has again come up before this court for the relief of bail. Patna High Court CR. MISC. No.43431 of 2024(2) dt.20-07-2024 2/2 counsel further submits that in the trial of the petitioner four witnesses, including the victim have been examined and the last witness PW 4 was examined on 03.08.2023 but thereafter no witness has turned up which shows the prosecution's lingering attitude and the petitioner has been languishing in jail since 01.10.2022.

4. Mrs. Nirmala Kumari, learned APP appearing for the State opposes the bail prayer of the petitioner.

Having regard to the above submissions and mainly taking into account the petitioner's custody period coupled with the examination of all material witnesses including the victim in the trial of the petitioner, as submitted by petitioner's counsel, this court is now inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection with Jamalpur P.S. Case No. 172 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
