The petitioner seeks bail in A.P.M. P.S. Case No. 49 of 2019, instituted for the offence under Section(s) 30(a), 41(1), 32(2) of the Bihar Prohibition & Excise Act, 2016. Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. The name of petitioner has been disclosed by driver of the vehicle. He disclosed before the police that petitioner has purchased 48 bottles total 18 litres of illicit liquor. Petitioner is in custody since 3.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.37321 of 2019(2) dt.20-06-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. Iind-cumSpecial Judge (Excise), Darbhanga, in connection with A.P.M. P.S. Case No. 49 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
