2. The petitioner has prayed for bail in connection with G.B. Nagar P.S. Case No. 560 of 2024 registered for the offence punishable under Sections 103(1) and 61(2) of B.N.S.

3. The case of the prosecution is that the petitioner along with others assaulted the father of the informant with lathi, danda, iron rod and bricks due to which the father of the informant died.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The nature of allegation is general and omnibus. It has

No.39401 of 2025(3) dt.04-09-2025 2/2 also been submitted by learned counsel for the petitioner that similarly situated accused person, namely, Raj Kumar has been granted bail by learned Co-ordinate Bench vide order dated 19.02.2025 in Cr. Misc. No. 6947 of 2025. The case of this petitioner stands on similar footing. He is in judicial custody since 26.04.2025.

5. Learned APP for the State has vehemently opposed the bail of the petitioner but conceded that co-accused has been granted bail by learned Co-ordinate Bench.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II, Siwan in connection with G.B. Nagar P.S. Case No. 560 of 2024.
