The petitioners seek anticipatory bail in Koransarai P.S. Case No. 9 of 2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.

Allegation has been made that accused persons have assembled and assaulted the victim and others mercilessly. There is counter case also which has been lodged by petitioner no.5 vide Koransarai P.S. Case No.8 of 2017 for offences under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian

Patna High Court Cr.Misc. No.24097 of 2017 (3) dt.25-08-2017 Penal Code.

In such view of the matter, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioners surrender before the court below within a period of four weeks, the court below will pass an order on the same day of their surrender, preferably on its own merit without being prejudiced by the order passed by this Court.
