In this case, the petitioners are seeking anticipatory bail in connection with Ghorasahan P.S. Case No.57 of 2019, registered for the offence under Sections 302 and 120(B)/34 of the Indian Penal Code.
The informant is the sister of petitioner no.2. As per the F.I.R., the petitioner no. 2 has taken loan for purchasing a four-wheeler and used to come to his mother for money in order to pay installments of the loan. It has also been alleged that both the petitioners used to quarrel with the mother of the informant.
Patna High Court CR. MISC. No.39207 of 2019(4) dt.26-07-2019 2/2 On 21.02.2019 they kept their mother inside the room and closed the door from outside, when it was opened, the mother of the informant was found dead. Allegation has been made against the petitioners to have killed the mother of the informant by strangulation.
On perusal of the case diary, it appears that witnesses have supported the case of the prosecution, even the sister of petitioner no.2 has made a statement against the petitioners.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected.
