The petitioner seeks bail in connection with Bachhwara P.S. Case No. 165 of 2016, registered under Sections 147, 148, 149, 341, 323, 324, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.
The accusation is that 16 persons named in the F.I.R. including the petitioner armed with lathi, Khanti, Garasa and iron rod came at the house of the informant, Ajit Kumar and started to remove the Nad and peg (Khuta). On protest by Suresh Yadav, father of the informant, this petitioner gave Khanti blow at his head, on which, he fell down and others also caused injury through lathi and stick.
Patna High Court Cr.Misc. No.20135 of 2017 (2) dt.11-05-2017 Learned counsel for the petitioner submits that occurrence took place due to land dispute, in which, petitioner's side also sustained injury, regarding which, Bachhwara P.S. Case No. 164 of 2016 is instituted, under Sections 323, 324, 379, 504 and 506 of the Indian Penal Code, on the basis of Fradbeyan of Bino Yadav. It is further submitted that petitioner has no criminal antecedent and is in custody since 27.02.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Begusarai, in connection with Bachhwara P.S. Case No. 165 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
