JUSTICE SANJAY PRIYA ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Fesar P.S. Case No. 33 of 2016 instituted for the offence under Sections-399, 402, 414 of the Indian Penal Code and u/S 25(i-b)a/26/35 of the Arms Act. It is alleged against the petitioner that he along with others were making preparation for committing dacoity. From the written report itself, it appears that there is no recovery from possession of this petitioner. The recovery is made from possession of co-accused Sanjay Noniya and Krishana Kumar. It has been submitted that the petitioner is in custody since 30-09-2016.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail
Patna High Court Cr.Misc. No.24028 of 2017 (2) dt.22-05-2017 2/2 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Fesar P.S. Case No. 33 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad subject to condition that both the bailors should be close relatives of the petitioners.
