JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending his arrest in a case instituted under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of Arms Act.
The allegation against the petitioners is that they along with co-accused persons came at the purchased land of the informant and opened fire and they also abused and assaulted the informant and his family members.
On behalf of the petitioners, it has been submitted that it is a case and counter case. There is allegation of firing but none was injured in course of occurrence. It is further submitted that
Patna High Court Cr.Misc. No.29246 of 2015 (2) dt.28-07-2015 2/2 other co-accused has been granted bail vide Cr. Misc. No. 51496/2014.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bagha, West Champaran at Bettiah in connection with Bagha P.S.Case No. 289 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
