JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 411 of the Indian Penal Code and Sections 25(1-b)A/26/35 of the Arms Act.

One country-made pistol was allegedly recovered from the possession of the petitioner. The petitioner is in custody since 25.05.2016.

Submission of the petitioner is that no progress has taken place in the trial and the petitioner shall fully cooperate in the trial of the case. Petitioner shall not indulge in tempering with the evidence.

Considering the aforesaid facts and the period

Patna High Court Cr.Misc. No.52766 of 2016 (4) dt.20-02-2017 2/2 already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar/Successor Court, in connection with Bhataha P.S. Case No.29 of 2016.
