JUSTICE ARUN KUMAR ORAL ORDER 17-07-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 9.1.2018, seeks bail in Gopalpur PS Case No. 251 of 2017 registered under Sections 302, 201 and 120B of the IPC.

The allegation in brief is that the FIR named accused persons including the petitioner called brother of the informant from his house, on the next day his dead body was found thrown away in the drainage after killing him by fire arm.

Learned Counsel for the petitioner submits that the deceased had gone along with all the FIR named accused persons in the previous night, except that circumstance there is no other material, only material later on collected during investigation is that one Vikash Kumar in his confessional statement stated that one Vikki Kumar shot at him because of dispute of commission for delivery of illicit liquor in which the deceased was indulged and the petitioner has got no criminal antecedent.
