The petitioner apprehends her arrest in connection with Kahalgaon P.S. Case No. 51 of 2019 registered under Section 366(A)/34 of the Indian Penal Code.
The accusation is of enticing away the daughter of the informant, aged about 16 years, by Amit Kumar with the help of his parents, Sakaldeep Yadav, Chandrawati Devi (petitioner) and Rubi Devi for the purpose to perform the marriage.
Learned counsel for the petitioner submits that, in fact, daughter of the informant left her parental house with Amit Kumar, son of petitioner, and performed the marriage but with
Patna High Court CR. MISC. No.39742 of 2019(2) dt.28-06-2019 2/2 ulterior motive the petitioner and her husband, who are mother and father of Amit Kumar, have falsely been implicated in this case.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case No. 51 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
