Arya, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Janipur (Phulwarisharif) PS Case No. 963/2018 registered for the offence punishable under Sections 341, 323, 324, 307 of the IPC and Section 27 of the Arms Act.
The allegation as per First Information Report is that due to quarrel between the informant and co-accused Naresh Paswan, the petitioner along with other accused persons arrived at the house of informant and started firing due to which three persons received injuries.
Learned counsel for the petitioner submits that the petitioner along with other accused persons have been

No.50491 of 2021(2) dt.01-04-2022 2/3 implicated in this case due to family dispute between the parties inasmuch as the petitioner was having love affair with the informant's niece and the marriage has also been solemnized between the petitioner and the neice of the informant. Learned counsel further submits that during course of investigation, the injuries caused to the informant, have been found to be simple in nature. He further submits that there is a case and counter case between the parties inasmuch as Phulwarisharif PS Case No. 969/2018 was lodged from the side of the petitioner against the informant and others. He further submits that co-accused, Naresh Paswan has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 21533/2019 (Annexure-4). Petitioner is in custody since 13.03.2021 and the charge-sheet has been submitted.
Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated co-accused, Ramesh Paswan has been granted bail by this Court, Petitioner is in custody since 13.03.2021, the charge-sheet has been submitted and there is a case and counter case between the parties, I am inclined to grant regular bail to the petitioner.

No.50491 of 2021(2) dt.01-04-2022 3/3 released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistratecum-Sub Judge-IX, Patna in connection with Janipur (Phulwarisharif) PS Case No. 963/2018.
