ANJANA MISHRA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned counsels appearing on behalf of the BSFC and the State. The petitioner is apprehending his arrest in connection with Bidupur P.S.Case No. 161 of 2015 registered under Sections 420, 409 of the IPC and Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that there is an allegation of defalcation of an amount of Rs.3,36,861.30 of paddy belonging to the State Food Corporation, Vaishali at Hajipur. Learned counsel further submits that the petitioner may be extended the privilege of bail as has been done in the cases of other similarly situated persons as he is willing to deposit 20% of the alleged defalcated amount.

Patna High Court Cr.Misc. No.29213 of 2015 (3) dt.06-10-2015 Considering the bona fide offer made by the petitioner, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Bidupur P.S.Case No. 161 of 2015 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that the aforementioned 20% amount shall be paid by the petitioner within a period of three months from the date of receipt/production of a copy of this order.
