JUSTICE SANJAY PRIYA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 414 of the Indian Penal Code, Sections 20(b)(ii)(B) and 27(A) of the N.D.P.S. Act.
It is alleged that total 3 kg. 750 grams of Ganja has been recovered from the printing press of one Asutosh Pandey. The seizure list has been filed as Annexure-1A wherein it has been mentioned that the Ganja has been seized from the printing press of Asutosh Pandey. In the written report. the name of the petitioner has come in the statement of Asutosh Pandey who has stated before the police that the petitioner along with his father were helping him in the business of Ganja.
In this manner, there is no recovery of Ganja from the possession of the petitioner. The name of the petitioner has been
Patna High Court Cr.Misc. No.46495 of 2016 (3) dt.13-01-2017 2/2 taken by co-accused Asutosh Pandey from whose printing press the alleged Ganja weighing 3 kg. 750 grams was recovered. It is mentioned in the complaint petition that the petitioner has clean antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Kaimur at Bhabua, in connection with Kudra P.S.
