JUSTICE RAKESH KUMAR ORAL ORDER 25-01-2017 Heard Sri Surendra Kishore Thakur, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.
This is the third attempt for grant of bail. Earlier the prayer for bail in Sessions Trial No.77/2016 arising out of Khodawandpur P.S. Case no.31/2014 registered for the offence under Sections 395, 397 and 120(B) of the Indian Penal Code was twice rejected.
In this case, by order dated 05.10.2016, a report was called for from the court below regarding stage of the case, which has been received and kept at Flag-A. The report suggests that after framing of charge, out of six witnesses, two witnesses have been examined and bailable warrants have been issued against
Patna High Court Cr.Misc. No.39289 of 2016 (3) dt.25-01-2017 2/2 other witnesses. On perusal of the report, it is evident that the trial is going on.
Keeping in view the facts and circumstances, particularly the fact that in this case, trial is going on, there is no reason to review my earlier order. The petition stands dismissed. However, it is observed that the trial court may take appropriate steps, so that the case may come to its logical end without unnecessary delay.
