JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This is an application for grant of anticipatory bail in connection with Tariyani P. S. Case No. 196 of 2018, disclosing offences under Sections 392, 411 of IPC and Section 27 of the Arms Act.
There is allegation that while the informant was going on motorcycle with collecting money of Rs.92,590/-, some miscreants dashed his motorcycle and looted away the cash and motorcycle. Petitioner is not named in the F.I.R. Submission of the learned counsel for the petitioner is that except confessional statement there is nothing against the petitioner.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner on the ground that there is confessional statement of the petitioner also showing the offence of the petitioner, as the case is under Sections 392/411
Patna High Court CR. MISC. No.38177 of 2019(4) dt.06-09-2019 2/2 of IPC, so custodial interrogation is required in this case. Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may surrender before the learned court below and make prayer for regular.
