The petitioner seeks bail in a case instituted for the offence under Section 366(A) of the Indian Penal Code. It is alleged in the written report that this petitioner had kidnapped the minor daughter of the informant Simran Kumari aged 17 years with intention to marry her. The victim girl has given the statement of 164 of Cr.P.C., wherein she has stated that this petitioner used to make her telephone call, although she did not love him. She went with the petitioner on his telephone call and stayed at various places as stated in her statement. In this manner, from the statement of the victim girl itself, it appears that she was consenting party. Petitioner is in

Patna High Court Cr.Misc. No.387 of 2017 (2) dt.30-01-2017 2/2 custody since 19.10.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No. 306 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
