Petitioner seeks bail in Alouli P.S. Case No.51 of 2017 instituted for the offence under Section(s) 399, 402 Indian Penal Code and Sections 25(1-b) a, 26, 35 of the Arms Act. It has been submitted that the petitioner is in custody since 02.03.2017.

From the written report, it appears that one country made Katta and 26 cartridges were recovered from the possession of this petitioner.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.37356 of 2017 (3) dt.13-09-2017 2/2 amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Alouli P.S. Case No.51 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.

The petitioner will co-operate in trial. He will remain physically present on each and every date of trial and his two consecutive absence without any reasonable cause will amount to cancellation of bail bond of the petitioner. (Sanjay Priya, J) JA/- U T
