The bail prayer of the appellant was earlier rejected vide order dated 15.02.2016 passed in Criminal Miscellaneous No.50655 of 2015 on merit after taking into consideration the nature of allegation against the appellant. A report, as called for, regarding the stage of the trial in respect to the appellant has been received through letter No. 241, dated 2017 to the Court of Addl. Sessions Judge-I, Sitamarhi, which disclosed that after framing of charge, out of seven witnesses, two witnesses have been examined and N.B.Ws have already been issued against the remaining witnesses.

Learned counsel for the appellant submits that

Patna High Court CR. APP (SJ) No.1518 of 2017 dt.24-01-2018 2/2 appellant is in custody since 02.03.2015.

Having considered the facts and circumstances of the case, I am not inclined to allow this appeal. However, the Court of Addl. Sessions Judge-I, Sitamarhi is directed to conclude the trial of the appellant within one year by taking all effective steps. 5.

Accordingly, this appeal is dismissed.
