The petitioner seeks bail in Katoriya P.S. Case No. 45 of 2021 (Special Excise Case No. 171/2021), registered for the offence punishable punishable under Section 56(d) of the Bihar Prohibition and Excise Act, 2016 and Mahua Flower Rule 3. 20 quintals of Mahua flower has been recovered from a pickup van of which this petitioner was driver. It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner was simply driving the vehicle and was not aware about the nature of consignment. Petitioner has no concern with the seized liquor. Petitioner is in custody since 04.03.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is
