The petitioner is in custody in connection with Ex. Complaint No. 54 of 2018 for the offence under Section 30(k) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is neither driver nor owner of the vehicle or the country made liquor. He submits that the petitioner was standing near the place of occurrence and only on the basis of suspicion he has been apprehended in this case. Referring to Para -3 counsel submits that the petitioner has no criminal antecedent.
