JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.
In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 342, 323 and 498 A of the I.P.C.
The allegation against the petitioner is that he being the husband of the informant used to torture and harass her and for that earlier also a case was lodged which was compromised, but again cruelty and harassment to the informant continued and ultimately she was ousted with her children from in-laws house. She was closed in a room with her children but due to intervention
Patna High Court Cr.Misc. No.48726 of 2014 (2) dt.23-04-2015 2/2 of villager she was saved. Her father came to settle the matter but he was also misbehaved by the petitioner.
Submission is of false implication and that the petitioner is still ready to keep her with full respect and dignity but she is not ready to live with the petitioner and she wants to live in a town, to which the learned A.P.P. opposes.
Considering the allegation of continuous harassment and cruelty and further noticing that the informant and her children were attempted to commit murder and as such this Court is not inclined to enlarge the petitioner on pre-arrest bail and accordingly his such prayer stands rejected in connection with Ramgarhwa P.S. Case No. 08 of 2014/ G.R. No. 42 of 2014 pending in the court of S.D.J.M. Raxaul at Motihari East Champaran.
