The petitioners are apprehending their arrest in a case instituted under Sections 302, 201 and 120(B)/34 of the Indian Penal Code.
The prosecution case, in short, is that the petitioners and four others in conspiracy with each other intoxicated the son of the informant and committed his murder and they threw the dead body near a canal.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioner No.1 is a lady. The names of the petitioners have come merely on the basis of suspicion. There is no direct or indirect allegation against
Patna High Court Cr.Misc. No.29059 of 2015 (3) dt.01-10-2015 the petitioners. The other co-accused have already been granted anticipation bail by this Court vide orders dated 31.7.2015 and 7.8.2015 passed in Cr. Misc. Nos.30674/2015 and 30354/2015. On behalf of the State, it is submitted that the petitioners are named in the first information report. In the facts aforesaid, let the petitioners, above named, in the event of their arrest/surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction the Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No.11 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
