Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code.

It is alleged by the informant that when she

No.50606 of 2021(3) dt.27-04-2022 2/3 went to the house of the petitioner to return her money back which she had given as loan, she was assaulted by the petitioner by iron rod on her head as a result of which she sustained bleeding injuries. The other family members of the petitioner also threatened the informant not to come again for demanding her money back. It is submitted by learned counsel for the petitioner that in the background of some land dispute, the present F.I.R has been registered. It is further submitted that for the alleged occurrence of 21.06.2021, the F.I.R has been registered on 24.06.2021. There is no accusation of repetition of blow against the petitioner. Moreover, the injuries of the informant have been found to be simple in nature. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Case No. 132 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
