The petitioner, who is in custody since 27.08.2017, seeks bail in connection with Sessions Trial No. 62 of 2018 arising out of Runnisaidpur P.S. Case No. 410 of 2017, G.R. No. 3534 of 2017 registered for the offences punishable under sections 341, 323, 307, 302 and 328/34 of the Indian Penal Code. The case has been registered on the basis of written report of the informant. The petitioner is husband of deceased who allegedly assaulted and committed murder of his wife. The deceased was married with the petitioner in the year 2008 and since the date of marriage the petitioner and his family members were demanding further dowry and she was done to death at her
Patna High Court Cr.Misc. No.29119 of 2018 (3) dt.28-06-2018 2/2 matrimonial house. The statement of witnesses recorded at page 6, 7, 8 and 16 of the case diary supports the allegation of demand and assault. In the post mortem report, the doctor has reported cause of death due to injury cause on head.
Considering the specific allegation of causing death by the petitioner who is husband of deceased, I am not inclined to grant bail to him. The prayer made on his behalf stands rejected. (Sanjay Kumar, J) Mahesh/- U T
