Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The FIR of the occurrence of robbery is against unknown. Petitioner is in custody since 05.11.2019. Submission is that petitioner was arrested in connection with some other case and at the police station the informant was called and identified the petitioner which has come in the case diary.

Considering lack of proper procedure of identification and no direct material against the petitioner as well as completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty

Patna High Court CR. MISC. No.38440 of 2020(4) dt.07-04-2021 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Makhdumpur Police Station Case No.388 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
