Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Ghoshi P.S. Case No. 201 of 2020, registered for the offences punishable under Sections 188, 379, 411 of the Indian Penal Code. Two tractors were seized loaded with illegally mined sand. As per allegation, the department has sustained loss of Rs. 13,230/-. Learned counsel for the petitioner has submitted that the petitioner is innocent and he is a person of clean antecedents. He has further submitted that the petitioner has deposited Rs. 13,230/- against the alleged loss sustained by the department. Considering the above-mentioned facts and

No.51104 of 2021(2) dt.11-07-2022 2/2 circumstances, especially, the clean antecedents of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Ghoshi P.S. Case No. 201 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
