JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner being husband of the complainant apprehends arrest in a case registered for the offences punishable under sections 498-A of the Indian Penal Code. It is alleged that the complainant opposite party no. 2 was married with the petitioner. According to the complainant, the petitioner assaulted her for non-fulfillment of demand of Rs.50,000/- by her parents.

On behalf of the petitioner it is submitted that the petitioner has no criminal antecedent. It is further submitted that the petitioner is ready to keep the complainant as wife but the same is not acceptable to her. It is further submitted that the petitioner is ready to deposit Rs.1,000/- (Rupees one thousand) per

On behalf of the State, it is submitted that the petitioner is named in the complaint petition. Considering the facts aforesaid, let the petitioner above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be enlarged on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Patna City in connection with Complaint Case no. 1367 of 2013, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973 and that the petitioner shall deposit a sum of Rs.1000/- (rupees one thousand) only per month in the court below which shall be released in favour of the complainant. If the petitioner fails to deposit the aforesaid amount consecutively for three months, the bail bonds of the petitioner shall be cancelled by the court below. (Sudhir Singh, J) Amin/- U
