JUSTICE SATYAVRAT VERMA ORAL ORDER 07-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Special Case No. 97 of 2021 arising out of Fatuha P.S. Case No. 512 of 2021, instituted for the offences under Sections 341, 354A, 354D, 323, 325, 504, 506, 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 14.07.2021, he is a person with clean antecedent, charge-sheet has been submitted and the informant in the FIR alleges that petitioner along with Abhishek @ Lallu Kumar used to tease her minor daughter by whistling when she sued to go for her coaching classes and on 11.07.2021, the petitioner along with co-accused whistled and even used filthy language and thus the victim informed the informant,

No.51240 of 2021(2) dt.07-02-2022 2/3 accordingly, the informant along with her husband went to the house of the accused person but they abused and petitioner assaulted the sister-in-law of the informant with stone causing injury on head and also assaulted the father of the victim and Rajan Kumar. It is also alleged that the father of the petitioner also pelted stones causing injury to Rajan Kumar on head. The learned counsel submits that petitioner has been falsely implicated in the case and even presuming what has been alleged to be true without admitting for the purpose of bail, the petitioner is a young boy aged about 21 years and his entire career would be jeopardized, if he is not granted bail and remained in custody in company of criminals. The learned counsel on instruction further submits that the petitioner will never indulge in such activities in future.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 14.07.2021, he is a person with clean antecedent, chargesheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned

Sessions Judge-VII-cum-Exclusive Court (POCSO Act), Patna, in connection with Special Case No. 97 of 2021 arising out of Fatuha P.S. Case No. 512 of 2021, with a condition that one of the bailor shall be the mother of the petitioner and in the event if the petitioner is implicated in a case of similar nature in future, the Court below will forthwith cancel his bail bond. The application stands allowed.
