The petitioner seeks bail in Hathauri P.S. Case No. 272 of 2018, instituted for the offence under Section(s) 376, 302, 120(B), 504 and 506/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is informant of the instant case. Petitioner has filed case levelling allegation against co-accused Mithlesh Sahni of establishing physical relation with his wife. The petitioner raised objection then Mithlesh Sahni gave threat to kill entire family members of the petitioner. The informant has raised suspicion that Mithlesh Sahni along with other co-accused persons have committed murder of his wife.
The Police during investigation made the informant
Patna High Court CR. MISC. No.37539 of 2019(2) dt.25-06-2019 2/2 (petitioner) as one of the accused on suspicion that he himself killed his wife.
Petitioner is in custody since 7.1.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge Xcum-A.C.J.M. X, Muzaffarpur, in connection with Hathauri P.S. Case No. 272 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
