JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-01-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 302/304(B)/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

It is a case of dowry death in which petitioner and his family members are alleged to have killed informant's daughter due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased. There is general and omnibus allegation against all the accused persons and no specific overt act has been alleged against the petitioner. Thrust of allegation is against the husband of the deceased who is already in custody. The petitioner is languishing in judicial custody since 27.1.2021. Petitioner lives separately and has no concern with the affairs of the victim and her husband. Similarly situated co-accused mother-in-law has already been allowed bail by a co-ordinate bench of this Court vide paragraph 15 of the bail petition.

Patna High Court CR. MISC. No.50714 of 2021(2) dt.24-01-2022 2/2 Learned APP for the State opposed the prayer for bail of the petitioner.

Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each in connection with Bakhtiyarpur P.S. Case No. 205/2020 to the satisfaction of the Chief Judicial Magistrate, Saharsa.
