JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2021 Heard Mr. Ajay Kumar Sinha, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Special Case No. 97 of 2018, arising out of Dhanarua P. S. Case No. 174 of 2018, dated 26.05.2018, instituted for offences under Section 354 of the Indian Penal Code and Section 12 of the POCSO Act, 2012.

The accusation against the petitioner is of

Patna High Court CR. MISC. No.37049 of 2020(3) dt.19-03-2021 2/3 having attempted to outrage the modesty of the minor daughter of the informant and abusing the family members.

The learned counsel for the petitioner has submitted that he is seventy years old person and only because in the past there was some dispute regarding opening of a balcony between the house of the informant and the petitioner, this case has been lodged at the instance of the informant.

The petitioner is in custody since 12.07.2019 but even the charges have not been framed in this case up till now.

Considering the aforesaid submissions on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-I, Patna cum Special Judge, POCSO, Patna, in connection with Special Case No. 97
