The petitioner seeks bail in connection with Rosera P.S. Case No. 155 of 2023 registered for the offence punishable under Sections 25 (1B) (a) and 26 of the Arms Act. As per prosecution case, one illegal loaded country made pistol has been recovered from possession of the petitioner when he tried to flee away from the bus when the bus was stopped.
Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence. He has falsely been implicated in this case and the prosecution case is doubtful. The petitioner has no criminal antecedent and he is languishing in jail custody since 25.02.2023.
Patna High Court CR. MISC. No.40829 of 2023(2) dt.14-07-2023 2/2 Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist , Rosera, Samastipur in connection with Rosera P.S. Case No. 155 of 2023.
