2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 403, 406, 421, 422, 423, 420, 415, 463, 120B, 504, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, it is alleged that this petitioner got the land of informant executed through a sale deed by an impostor lady falsely claiming to be Kamini Sinha.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.47964 of 2025(2) dt.05-08-2025 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is bona fide purchaser of the land appertaining to Mauza- Beur, Thana No. 33, Thana Code191, Tauzi No. 5071, Khata No. 141. Survey Plot No. 1617, Simit Plot No. 2, Rakwa- 10 dhur, District- Patna vide registered Sale Deed No. 4362 dated 27.03.2022 and she purchased the land after payment of due consideration money. It is further submitted that for the same land a title suit bearing Title Suit No. 113 of 2024 (Most. Kamini Sinha versus Madhu Gupta and others) has already been filed on 16.03.2024 in which petitioner and others have already appeared through advocate and later on, informant filed a complaint case bearing Complaint Case No. 4763 of 2024 leading to lodging of the present F.I.R.. It is further submitted that the dispute is with regard to sale and purchase of land which is purely civil in nature and informant has got other alternative remedies. Petitioner is a lady and claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of dispute and clean antecedents of the petitioner,
Patna High Court CR. MISC. No.47964 of 2025(2) dt.05-08-2025 3/3 the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Patna in connection with Beur P.S. Case No. 517 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
